Commissioners Corner: Towing Orders

The issue of vehicle towing, including if, when and how the Body Corporate can tow "illegally" parked vehicles, has been raised at a number of public information seminars presented by my office.
There are no simple answers to these types of questions. Each situation is different and it depends on the facts to hand, including what-if any-by-laws about parking and towing are applicable.
In this article, I will provide an overview of some adjudicators' orders about towing as a way of providing guidance about this sometimes vexed issue, by presenting some of the adjudicators' statements of their reasons.

In Part 1 of our Approving Common Property Improvements series, we covered everything you need to know when it is the Body Corporate that wants to authorise its own improvements and the process it must follow which can be reviewed here.
We will now review the varying scenarios for when a low owner seeks approval to make an improvement defining the improvement range stated within the legislation.
